Randy Koschnick, Wisconsin Supreme Court

The Honorable Randy Koschnick has almost 25 years of legal experience, having served many roles in the law - as a public defender, in a prosecutor’s office, and most recently as a Judge for the Jefferson County Circuit Court and Deputy Chief Judge for the 3rd Judicial District.

Judge Koschnick has also served as a Board Member of the Criminal Law section for the State Bar of Wisconsin, which consists of prosecutors and defense attorneys who provide opinions and advice on pending legislation before the courts.

Judge Koschnick has also participated in what is popularly known as “The Bloody Shirt Case” (State v. Knapp). The Judge presided over a case at the trial level where he ruled that a bloody shirt police had seized from the defendant’s home was admissible despite the fact that the defendant had not been read his Miranda rights. The case was appealed and Justice Abrahamson voted with a majority of the court to reverse admission of the shirt based on a reading of federal law.  The case was then appealed to the United States Supreme Court, which ruled that the Wisconsin court’s reading of federal law was incorrect, and the decision of the lower court was vacated.  On remand, Justice Abrahamson ruled with a majority of the justices again to keep out the bloody shirt, but this time the ruling was based on the Wisconsin constitution – a basis not even considered the first time around.  This decision gave Wisconsin criminal defendants rights more expansive than in any other state in the country.

In State v. Post, Justice Abrahamson cast a lone vote that the Sexual Predator Commitment Statute (Wis. Stat. Ch. 980) was unconstitutional.  In doing so, Justice Abrahamson compared the “danger” posed by sexually violent criminals with the “danger” posed by the ruling of the majority and the law itself, which had been passed by our legislature and signed by the governor.1
